Project Art of Humanity

1. Acceptance of Terms

By accessing or using Project Art of Humanity (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not use the Platform.

2. User Accounts

To contribute to projects on our Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update this information as necessary.

3. Intellectual Property Rights

3.1 Assignment of Rights. By contributing to any project on the Platform, you hereby irrevocably assign to Project Art of Humanity all right, title, and interest worldwide in and to your contributions, including all intellectual property rights therein. This assignment includes all rights to reproduce, distribute, display, perform, prepare derivative works, and otherwise use and exploit your contributions in any form, media, or technology now known or later developed.

3.2 Waiver of Moral Rights. To the extent permitted by applicable law, you waive any moral rights or equivalent rights you may have in your contributions, such as your right to be identified as the author and your right to object to derogatory treatment of your contributions.

3.3 Representation and Warranty. You represent and warrant that you have the legal right to grant the rights described in this section and that your contributions do not violate any law, infringe any third-party rights, or breach any agreement or obligation to which you are subject.

3.4 Platform Content. All content provided by the Platform, including but not limited to project designs, themes, templates, software, and website design, is owned by Project Art of Humanity or its licensors and is protected by copyright, trademark, and other intellectual property laws.

4. User Conduct

You agree to use the Platform in accordance with all applicable laws and regulations. Additionally, you agree not to:

• Violate the project themes, scale references, or quality standards established for each project
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Platform or servers or networks connected to the Platform
• Use any robot, spider, scraper, or other automated means to access the Platform
• Attempt to circumvent any measures we use to prevent or restrict access to the Platform

5. Content Moderation and Voting

The Platform allows users to vote on contributions. Contributions that receive sufficient downvotes (as determined by the Platform's rules) may be removed from the canvas. Project Art of Humanity reserves the right to remove any contribution at its sole discretion, regardless of voting outcomes.

6. Fees and Payments

Project Art of Humanity may charge fees for certain projects or features. All fees are non-refundable unless otherwise specified. By paying a fee, you agree to our payment terms and acknowledge that this does not grant you any ownership rights in the resulting artwork.

7. Limitation of Liability

To the maximum extent permitted by law, Project Art of Humanity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with these Terms, whether based on contract, tort, negligence, strict liability, or otherwise, even if Project Art of Humanity has been advised of the possibility of such damages.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis. Project Art of Humanity disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Indemnification

You agree to indemnify, defend, and hold harmless Project Art of Humanity and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

10. Modifications to Terms

Project Art of Humanity reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

11. Termination
